It’s been really quiet around here. What’s the status of Michael Miller’s legal efforts and our de-listed stock shares? Any chance of the mine actually doing any mining?

Summer has officially come to Alleghany.

Multiple kinds of roses – some, cultivated, most wild – which bloomed throughout Alleghany during the month of June have given way to the usual crop of sweetpeas and dry, yellow grass. Temperatures have been intense these past few weeks; upper nineties to low hundreds are as hot as this small town ever gets and everyone is feeling it, though we feel blessed to not have to suffer through the intense, scorching heat of the valley and neighboring foothills.

Most of the town’s apple trees and damson plums are fruiting. Not so for the heirloom trees that grow just outside the Sixteen to One office. While most apple trees in town escaped unscathed, a freezing rain in late April damaged the blossoms. Far as SCOOP can tell, there will be no golden buckets of Sixteen to One apples this year. On the other hand, the thick swatches of Himalayan blackberries which flourish in the Alleghany area are covered in fruit. SCOOP predicts a bumper crop of them later this summer.

The town of Alleghany has seen extensive repairs to its water-storage tank. Replaced at the end of 2018, the tank began to leak by 2020, and a subsequent inspection found several structural and material defects. Taken down for repairs in May of this year, the rebuilt tank is nearly completed.

SCOOP is also sad to report the felling of an ancient, 100-year oak tree on Main Street. In the neighborhood of eighty to ninety feet high, with a trunk diameter of over two feet, the oak provided shade for many decades just up the road from the Underground Gold Miners Museum. Wary that the enormous, top-heavy tree had become a hazard – as it overhung both power lines and properties – the home-owner opted to allow the tree to be felled in the first weeks of July. SCOOP understands, but cannot help but feel a little bad. Hopefully, new growth will sprout from the trunk and the tree itself will live on.

    What makes a criminal?

Studies indicate the personality traits of hostility, narcissism and impulsivity correlate with criminal and delinquent behavior.

What is the name of a person who commits a crime?

Perpetrator: a person who commits a crime, also known as an offender.

What is the literal definition of a crime?

The Oxford English Dictionary defines crime simply as: “An action or omission which constitute and offence and is punishable by law.”

What are the three definitions of crime?

Crimes, briefly defined as acts or omissions punishable by law, must be (A) Prohibited (B) Public and (C) Punishable.

What three conditions must be present before a prosecutor charges a criminal case?

A prosecutor should seek or file criminal charges only if the prosecutor reasonably believes that the charges are supported by probable cause, that admissible evidence will be sufficient to support conviction beyond a reasonable doubt, and that the decision to charge is in the interest of justice.

    What is considered a victim?

“Victims” means persons who, individually or collectively, have suffered harm, including physical or mental injury, emotional suffering, economic loss or substantial impairment of their fundamental rights through acts or omissions that are in violation of criminal laws operative within Member States.

What defines a behavior as a crime?

Crime is a behavior, either by act or omissions, defined by statutory or common law as deserving of punishment or penalty. Although most rimes require the element of intent, certain minor crimes may be committed based on strict liability even if the defendant had no specific mindset with regard to the criminal action.

What are the 3 elements that must be proved to convict someone of a crime?

In general, every, crime involves three elements. First, the act or conduct (actus reus). Second, the individuals mental state at the time of the act (mens rea). And third, the causation between the act and the effect. (typically either proximate causation or but-for causation)

What 2 elements must be present for someone to be convicted of a crime?

Generally speaking, for a person to be found guilty of a criminal offense he or she must have committed an illegal act (actus reus) and had the required “state of mind” (mens rea) for the criminal offense. Both elements of the offense, the actus rea and the mens rea, must be proven beyond a reasonable doubt.

What is considered a “white collar criminal”?

White-collar crime is generally non-violent in nature and includes public corruption, health care fraud, mortgage fraud, securities fraud, and money laundering to name a few. The term “Securities Fraud” covers a wide range of illegal activities, all of which involve the deception of investors or the manipulation of the financial markets. It is characterized by promises of high rates return with little or no risk.

What are the consequences of securities fraud?

Securities fraud convictions can result in significant criminal penalties. Under Section 1348, the federal statue on securities and commodities fraud, individuals guilty of securities fraud can face substantial fines as punishment. Additionally, imprisonment is a possible outcome, with maximum sentence of 25 years.

Is securities fraud a criminal offense?

Securities and commodities fraud is a serious crime under federal law, punishable by a maximum imprisonment of 25 years, plus a fine. 18 U.S.C. 1349 confirms that an attempt or conspiracy to commit a violation of 18 U.S.C. 1348 will be punished in the same manner as a violation of Section 1348 itself.

Greetings fellow FORUM friends. Scoop returns. You are invited to participate in the updated website and FORUM topics.
expect one more month of cold but mild Alleghany winter. Observed geese are heading north today. Remember that big apple tree in front of Sixteen to One office? Hairy Headed woodpeckers are pecking away. Maybe Spring weather is moving into the 4600 elevation of Tahoe National Forest. The Ridge Road communities of Pike, Forest and Alleghany were loaded with apple trees 100 years ago. Gold miners and their families loved apples. Some trees remain and provide local settlers a delicious fall treat.

Big snow storms are common in March and even April. The Sierra high country snow pack is about 76% for this time. Big difference is the high rainfall so the trees are very happy. For new readers or others not familiar with Alleghany, it is 19 miles of blacktop road where pavement ends and four dirt roads wind into the Tahoe forest…home to about 45 people.

Douglas Charlton, a director and Chief Execu􀆟ve Officer of Original Sixteen to One Mine Inc., has provided me with the following statement regarding the setlement of the Administra􀆟ve Proceeding filed by the SEC against Original Sixteen to One Mine Inc. and the revoca􀆟on of the registra􀆟on of the securi􀆟es of Original Sixteen to One Mine Inc.
“The management of Original Sixteen to One Mine Incorporated (the Company) discloses to the shareholders of the Company that on November 8, 2023, the Company entered into a setlement with the Securi􀆟es and Exchange Commission (Commission) regarding the Administra􀆟ve Proceeding and No􀆟ce of Hearing Pursuant to Sec􀆟on 12(j) of the Securi􀆟es Exchange Act of 1934, Admin. Proc. No. 3-21690 (the Proceeding) ini􀆟ated by the Commission against the Company. In the Proceeding, the Commission alleged the Company failed to comply with Exchange Act Sec􀆟on 13(a) and Rules 13a-1 and 13a-13 thereunder by failing to file required periodic reports since the quarter ending September 30, 2022 and filing materially deficient Form 10-K annual reports for fiscal year 2012 through 2021 without audited financial statements or being accompanied by any cer􀆟fica􀆟ons required by the Sarbanes-Oxley Act of 2002. Pursuant to the setlement, without admi􀆫ng or denying the alleged findings stated in the Order Ins􀆟tu􀆟ng the Proceeding, except as to the jurisdic􀆟on of the Commission over the Company and the subject mater of the Proceeding, which are admited, the Company consented to the revoca􀆟on of the registra􀆟on of each class of securi􀆟es of the Company registered pursuant to the Securi􀆟es Exchange Act of 1934 effec􀆟ve November 7, 2023 (the Setlement).
The prior management of the Company received a delinquency leter from the Commission dated September 20, 2022, reques􀆟ng the deficiencies in the Company’s Form 10-K annual reports for fiscal year 2012 through 2021 stated above be rec􀆟fied within fi􀅌een days. The current Board of Directors and management of the Company were elected and served from November 3, 2022. The delinquency leter was not shared by prior Company management with the current management of the Company.
The decision of the current Board of Directors of the Company to setle the Proceeding took into account the con􀆟nued refusal by prior Company management to grant access to any corporate records for the Company, including historical financial records of the Company needed to prepare accurate periodic reports, audited financial statements and cer􀆟fica􀆟ons under the Sarbanes-Oxley Act of 2002 required by the Securi􀆟es Exchange Act of 1934, the extended period of 􀆟me since the financial statements of the Company were audited and an alloca􀆟on of the limited capital resources available to the Company.”

    David & Group,

Yes, the mine has changed hands and has been acquired by “Quartzview”. However, it’s not clear to me whether the mine is still actually operating or not. Since there now seems to be such a dearth of information, I have to assume that it is not operating and has been closed – perhaps permanently.

I hope that I’m wrong on that assumption, but things are not looking good.

My real name is now on this forum, used to be Idavid. I have been following the activities of this mine for over 15 years. It has been very kind of fellows participation of various mining ventures of discussion. I had hoped that a mining resurge would happen for this historical gold reserve. It would be a boon for the local economy for which my family is part of. So i am curious. Has the mine changed ownership? What are the future production planes? I hope to continue sharing our thoughts on this forum, Thank you all for allowing me to join in on this forum.

    Best regard David Ingraham

QuartzView called for a special shareholder meeting of the Original Sixteen to One Mine which was held on November 3 at 11:00am in the map room at the mine. Shareholders could have joined by phone or in person. A vote was taken and the old board of the Original Sixteen to One Mine, Mike Miller and Robert Besso were voted off the board. There are 14,870,631 shares outstanding, 9,101,004 voted to change the board. Mr. Scott Robertson had resigned earlier in the year. The 3 new board members are Charles Crompton, Dave Conner and Doug Charlton.

I had long given up on this forum and continued to use the one on the old website until that site was taken down.

When I tried to register for the new forum, it prompted me that “registration is closed”.

Well, just for Kicks and Cheerios, I tried to log in under my old credentials. I was amazed that it worked! Evidently, all the people who were registered for the old forum on the old website, got dragged to the new one!

So, it looks like we might be back in business.

    Hi,
I’m changing the topic a little bit, but this is Miscellaneous so I figured its ok.
I didn’t realize there was a new website until I received my latest annual report in the mail this weekend. Perhaps I missed this before but I am here now.
Registering for this forum was really hard, but I finally managed to figure out how its done.

So far the forum looks nice.
