It’s been really quiet around here. What’s the status of Michael Miller’s legal efforts and our de-listed stock shares? Any chance of the mine actually doing any mining?

Multiple kinds of roses – some, cultivated, most wild – which bloomed throughout Alleghany during the month of June have given way to the usual crop of sweetpeas and dry, yellow grass. Temperatures have been intense these past few weeks; upper nineties to low hundreds are as hot as this small town ever gets and everyone is feeling it, though we feel blessed to not have to suffer through the intense, scorching heat of the valley and neighboring foothills.
Most of the town’s apple trees and damson plums are fruiting. Not so for the heirloom trees that grow just outside the Sixteen to One office. While most apple trees in town escaped unscathed, a freezing rain in late April damaged the blossoms. Far as SCOOP can tell, there will be no golden buckets of Sixteen to One apples this year. On the other hand, the thick swatches of Himalayan blackberries which flourish in the Alleghany area are covered in fruit. SCOOP predicts a bumper crop of them later this summer.
The town of Alleghany has seen extensive repairs to its water-storage tank. Replaced at the end of 2018, the tank began to leak by 2020, and a subsequent inspection found several structural and material defects. Taken down for repairs in May of this year, the rebuilt tank is nearly completed.
SCOOP is also sad to report the felling of an ancient, 100-year oak tree on Main Street. In the neighborhood of eighty to ninety feet high, with a trunk diameter of over two feet, the oak provided shade for many decades just up the road from the Underground Gold Miners Museum. Wary that the enormous, top-heavy tree had become a hazard – as it overhung both power lines and properties – the home-owner opted to allow the tree to be felled in the first weeks of July. SCOOP understands, but cannot help but feel a little bad. Hopefully, new growth will sprout from the trunk and the tree itself will live on.

Generally speaking, for a person to be found guilty of a criminal offense he or she must have committed an illegal act (actus reus) and had the required “state of mind” (mens rea) for the criminal offense. It is characterized by promises of high rates return with little or no risk.

Securities fraud convictions can result in significant criminal penalties. Under Section 1348, the federal statue on securities and commodities fraud, individuals guilty of securities fraud can face substantial fines as punishment. Additionally, imprisonment is a possible outcome, with maximum sentence of 25 years.
Is securities fraud a criminal offense?
Securities and commodities fraud is a serious crime under federal law, punishable by a maximum imprisonment of 25 years, plus a fine. 18 U.S.C. 1349 confirms that an attempt or conspiracy to commit a violation of 18 U.S.C. 1348 will be punished in the same manner as a violation of Section 1348 itself.

expect one more month of cold but mild Alleghany winter. Observed geese are heading north today. Remember that big apple tree in front of Sixteen to One office? Hairy Headed woodpeckers are pecking away. Maybe Spring weather is moving into the 4600 elevation of Tahoe National Forest. The Ridge Road communities of Pike, Forest and Alleghany were loaded with apple trees 100 years ago. Gold miners and their families loved apples.Some trees remain and provide local settlers a delicious fall treat.Big snow storms are common in March and even April. The Sierra high country snow pack is about 76% for this time. Big difference is the high rainfall so the trees are very happy. For new readers or others not familiar with Alleghany, it is 19 miles of blacktop road where pavement ends and four dirt roads wind into the Tahoe forest…home to about 45 people.

“The management of Original Sixteen to One Mine Incorporated (the Company) discloses to the shareholders of the Company that on November 8, 2023, the Company entered into a setlement with the Securies and Exchange Commission (Commission) regarding the Administrave Proceeding and Noce of Hearing Pursuant to Secon 12(j) of the Securies Exchange Act of 1934, Admin. Proc. No. 3-21690 (the Proceeding) iniated by the Commission against the Company. I.
The Securities and Exchange Commission (“Commission”) deems it necessary and
appropriate for the protection of investors to accept the Offer of Settlement submitted by
Original Sixteen to One Mine, Inc. (“OSTO” or “Respondent”) pursuant to Rule 240(a) of the
Rules of Practice of the Commission, 17 C.F.R. § 201.240(a), for the purpose of settlement of
these proceedings initiated against Respondent on September 21, 2023, pursuant to Section 12(j)
of the Securities Exchange Act of 1934 (“Exchange Act”).
II.
Solely for the purpose of these proceedings and any other proceedings brought by or on
behalf of the Commission, or to which the Commission is a party, and without admitting or
denying the findings herein, except as to the Commission’s jurisdiction over it and the subject
matter of these proceedings, which are admitted, Respondent consents to the entry of this Order
Making Findings and Revoking Registration of Securities Pursuant to Section 12(j) of the
Securities Exchange Act of 1934 as to Original Sixteen to One Mine, Inc. (“Order”), as set forth
below.

On the basis of this Order and Respondent’s Offer, the Commission finds that1
:
1. Original Sixteen to One Mine, Inc. (“OSTO”) (CIK No. 74925) is a
California corporation located in Alleghany, California with a class of securities
registered with the Commission under Exchange Act Section 12(g). As of September 7,
2023, unsolicited quotations for the common shares of OSTO were quoted on OTC Link
operated by OTC Markets Group Inc.
2. OSTO has failed to comply with Exchange Act Section 13(a) and Rules
13a-1 and 13a-13 thereunder because it has not filed any periodic reports with the
Commission since the period ended September 30, 2022. OSTO has also failed to
comply with Regulation S-X because its Forms 10-K for the fiscal years 2012 through
2021 were materially deficient because they failed to include audited financial statements
and failed to include the certifications required by the Sarbanes-Oxley Act of 2002.
IV.
In view of the foregoing, the Commission deems it necessary and appropriate for the
protection of investors to impose the sanction specified in Respondent’s Offer.
Accordingly, it is hereby ORDERED that:
Pursuant to Section 12(j) of the Exchange Act, the registration of each class of
Respondent’s securities registered pursuant to Exchange Act Section 12 be, and hereby is,
revoked. The revocation is effective as of November 7, 2023.

Yes, the mine has changed hands and has been acquired by “Quartzview”. However, it’s not clear to me whether the mine is still actually operating or not. Since there now seems to be such a dearth of information, I have to assume that it is not operating and has been closed – perhaps permanently.
I hope that I’m wrong on that assumption, but things are not looking good.

It has been very kind of fellows participation of various mining ventures of discussion. I had hoped that a mining resurge would happen for this historical gold reserve. It would be a boon for the local economy for which my family is part of. So i am curious. Has the mine changed ownership? What are the future production planes? Shareholders could have joined by phone or in person. A vote was taken and the old board of the Original Sixteen to One Mine, Mike Miller and Robert Besso were voted off the board. There are 14,870,631 shares outstanding, 9,101,004 voted to change the board. Mr. Scott Robertson had resigned earlier in the year. The 3 new board members are Charles Crompton, Dave Conner and Doug Charlton.
